if the judge says “it will be sealed and dismissed if you stay out of trouble for 6 months”?

this was in NYC

can I say that Ive never been convicted of a crime(other than a traffic violation?)

also, what kind of trouble are they talking about

my parents have called hte cops twice since the judge told me that statement, and each time they didnt do anything except write a police report

does that count?

  1. yes.

  2. It’s up to the judge, but usually means no more convictions for misdemenors or felonies. Yes you can say never convicted.

  3. Well if we can take the Judge’s words for granted then we can assume you can say you have never been convicted.

As for the cops calls that doesn’t count UNLESS you are charged.

But stop playing with your luck; the cops could get tired of the calls and arrest you (for any reason like disturbance of peace) just to give you a lesson.

  4. Yes you can because it will be sealed. The dismissal means no conviction and only if you apply for a Govt job will they find it with a FBI finger print check. You can still say no conviction but not that you have never been arrested or they will call your lie. Usually when this dismissal thing happens it’s because they don’t have enough to convict you with out a trial that may still fail to convict. So they give you a ultimatum which basically says we will get you we find your doing something again.
