Which California traffic violation code should it be?
Police officer cited me for not completely stop before I turn RIGHT on a red light. Which traffic code should he cite me on?
21453(a) - Red signal Vehicular Responsibilities
or
21453(b) - Red signal Vehicular Responsibilities with Right Turn?

The “Complete Stop” rule anywhere is retarded. Unnecessary and a waste of time and car brakes. is it really that bad if someone is going .02 miles per hour at a 4-way stop or come to a complete stop?

I think he must’ve gotten it ALL WRONG…
If you were wearing that shirt, I’m certain he wasn’t paying much attention to CVC this number, or CVC that number…

The technical would be (b) but both violations are the same as far as cost and demerits.

It looks like the second one. However, I was told if you count to 3 seconds when fully stop is considered a stop. Not sorta stop then go like drivers would do when they see a yield sign.

The answer is B. When coming to a red signal you may turn right IF you come to a complete stop first and the traffic allows for you to go. The addition of “with right turn” is a stipulation for just this scenario. Without this stipulation, the law applies to those who run the red light.

Unlucky you live in California and in most states red right turn signal means you can turn if you can without stopping.
