I got a DWI convication in Fort Worth, TX.?
I failed sobriety tests because i had a cut in my leg that did not allow me to walk really good. I do not have good balance to start off with, seeing that I am not in good shape, nor do i exercise often. I blew in breathlizer, and got a .03, which is below the .08 limit. I still did jail for one night, and got bailed out. Do you think i can countersue for attorney costs? which is almost 3000?

Send them a bill. If they don’t pay it, then talk about suing.

You could have gotten an attorney for a lot less than $3000. You got took. I don’t know if you can successfully sue or not but I doubt it.

no….you can try to sue a police officer and/or department… but without a rock solid case… the officers attorney will tear your case to shreds in the courtroom.
you were jailed because you were believed to be under the influence… not intoxicated because your BAC was under the legal limit, but under the influence because you couldnt walk correctly.
My question is.. .did the officer know that you had a cut in your leg? because if so you should have been given a different series of sobriety tests. if you told him…it will be in the video of the tests and arrest. all police officers in tarrant county record every encounter with people… even if you dont think youre being recorded… you are. this is to protect them in cases.
the only thing you can do is show the judge medical evidence that you have a cut severe enough to hinder movement and balance and hope that the case gets dismissed.
